9. Dispute Resolution
If a dispute arises, our customer service team will be happy to help resolve the problem.
Dispute Resolution: Overview
APPERATOR LTD is committed to resolving conflicts with users without resorting to legal action. In the event of a dispute between the company and a user, both parties are committed to make their best efforts to reach a fair and mutually beneficial resolution. This will be done through the mandatory informal dispute resolution process described below. In certain situations, third party intervention may be required to resolve a dispute. This Dispute Resolution Agreement identifies the preferred methods for resolving such conflicts.
You and APPERATOR LTD agree that all disputes, claims or controversies arising out of or relating to these terms and conditions. Their applicability, breach, termination, validity, performance and interpretation, or arising out of your use of the services or communication with LTD (collectively, «disputes»), which cannot be resolved informally, shall be resolved exclusively in small claims court or binding individual arbitration, and you agree to waive the right to trial by jury and to bring suit in any other court.
You and APPERATOR LTD also agree to sue each other only in your individual capacities and not as a plaintiff or class member in any class or collective proceeding, whether in court or in arbitration.
Mandatory Informal Dispute Resolution Process
Before filing a claim against the other party, you and courseplanet must engage in the preliminary informal dispute resolution process described below:
- The party filing the claim shall send the other party a brief written statement ('Statement of Claim'), including its full name, mailing address and e-mail address, explaining (a) the nature and details of the dispute and (b) a proposal for resolution, including the amount of money requested and method of settlement. Sending a claim statement suspends the calculation of any applicable statute of limitations for a 60-day period beginning on the date the claim is received. A statement of claim should be sent to courseplanet's e-mail address at support@courseplanet.shop and may also be sent by registered mail to the following address: 39/5 Granton Crescent, Edinburgh, United Kingdom, EH5 1BN.
courseplanet will use the e-mail address associated with your cabinet to contact you unless you specify otherwise.
Upon receipt of the Statement of Claim, either party agrees to attempt in good faith to resolve the dispute informally. If no agreement can be reached within 60 days of receipt of the Statement of Claim, either party shall have the right to file a formal action against the other party in small claims court or initiate individual arbitration in accordance with the terms of this Dispute Resolution Agreement.
- Failure to comply with this process shall be deemed a content breach of these Terms.
10. Updating these Terms
We may occasionally update these Terms to clarify the rules or if new regulations or other terms become available (for example, if new features are added). courseplanet reserves the right, at its sole discretion, to make changes to these Terms at any time. If we make content changes, we will notify you by email or other known methods, such as by sending a notice to the email address in your cabinet or by posting a notice on our website. Changes will be effective upon posting unless otherwise agreed. Your continued use of our Services after changes are made constitutes your acceptance of those changes. The new Terms supersede all previous versions.
