This User Agreement (hereinafter referred to as the “Agreement”) defines the terms and conditions for using the website https://courseplanet.shop/ (hereinafter collectively referred to as the “Platform”).

This Agreement is concluded between the Internet user (hereinafter referred to as the “User”) and 4TEQ LTD, a company registered under number 16000104, with its legal address at 7 Bell Yard, London, United Kingdom, WC2A 2JR. Collectively, they are referred to as the Parties, and individually as a Party.

By accepting and adhering to the terms set forth in this Agreement, the User acknowledges that compliance with these terms is a mandatory requirement for registering on the Platform(s) and using the services provided.

According to the Qualifications and Quality Assurance (Education and Training) (Amendment) Act 32 of 2019, the https://courseplanet.shop/ platform is not an educational institution subject to licensing. The services provided on the Platform are informational and consulting in nature and do not constitute formal education. They are not accompanied by the issuance of state-recognized educational certificates or diplomas.

Materials and services posted on the Platform are for information and consulting purposes only and are not accompanied by the issuance of state-recognized diplomas, certificates or other official educational documents.

The Platform does not guarantee the achievement of specific educational outcomes by the User and is not responsible for the interpretation or use of the materials provided.

This Agreement governs the relationship between the Parties, establishes the rights and obligations of Users, and outlines their responsibilities for any violations of the terms of use of the Platform.

1. Definitions and Key Terms

Website – The online resource available at https://courseplanet.shop/.

User – Any individual who has entered into an agreement with the Platform Administration by accepting the User Agreement at https://courseplanet.shop/terms-of-use/.

Platform – A digital system that provides Users with access to educational and related informational content in electronic format.

User Agreement – This legal document governing the use of the Platform, established in accordance with the Consumer Rights Act 2015.

Personal Account – A private section of the Website, accessible only after the User completes authorization by entering their Registration Data. The account dashboard is available at https://courseplanet.shop/dashboard/.

Registration Data – Information provided by the User when creating an account on the Platform. This includes, but is not limited to, an email address, contact phone number, and any subsequent updates or modifications made by the User while managing their Personal Account. Registration is required at https://courseplanet.shop/student-registration/ for students and https://courseplanet.shop/instructor-registration/ for instructors. Submission of accurate registration data is essential for User identification and compliance with this Agreement.

  • Platform Administration – The entity responsible for managing and operating the Platform, registered at 7 Bell Yard, London, United Kingdom, WC2A 2JR.

    User-Generated Content – Any materials, including but not limited to, documents, videos, articles, or other content, that Users upload or publish on the Platform.

    2. SCOPE OF THE AGREEMENT

    2.1. Purpose of the Agreement

    This Agreement defines the conditions under which the User is granted access to the services and materials available on the Platform. By accepting the terms of this Agreement, the User acknowledges that they are permitted to use the Platform’s content and services in accordance with the specified conditions. The Platform provides access to various materials and functionalities designed to enhance the User’s experience.

    2.2. Services Provided by the Platform

    2.2.1. Access to Materials

    • The User can view and access materials available on the Platform.
    • The Platform provides an option to purchase and download content where applicable.
    • The materials available include, but are not limited to, text documents, video lessons, articles, interactive content, and other digital educational resources.

    2.2.2. Publishing and Interaction

    • The User has the ability to upload and share their own materials on the Platform.
    • Users can comment on existing content, leave reviews, and provide ratings for courses, lessons, and other materials.
    • All uploaded materials must comply with the Platform’s content policies and intellectual property rights regulations.

    2.2.3. Information on Content and Purchases

    • Users can access detailed descriptions of materials available on the Platform.
    • The Platform provides pricing, access conditions, and purchase options for content.
    • The User can obtain information about free and paid materials before making a decision to purchase.

    2.2.4. Communication with Other Users

    • The Platform enables Users to interact with each other through built-in communication tools.
    • Users can engage in discussions, forums, or direct messaging where applicable.
    • The Platform may facilitate networking and collaboration among Users with similar educational interests.

    2.2.5. Participation in Online Webinars

    • The Platform provides opportunities for Users to attend online webinars.
    • Webinars may include live sessions, Q&A opportunities, and instructor-led discussions.
    • Some webinars may require separate registration and payment depending on the access level.

    2.3. Payment Terms and Conditions

    The User acknowledges and agrees that access to certain services and content on the Platform is provided on a paid basis, unless explicitly stated otherwise.

    Some materials and services may be available for free, while others require a one-time payment, a subscription, or another form of compensation.

    The User must review pricing and payment conditions before making any purchases on the Platform.

    All payments made on the Platform are subject to the terms outlined in the Payment and Refund Policy (refer to Section X of this Agreement).

    By using the services of the Platform, the User confirms their understanding that access to paid content is granted only after successful payment processing, and refunds are subject to the conditions specified in this Agreement.

    3. USER REGISTRATION

    3.1. Registration Process

    To access certain services and features on the Platform, the User must complete the registration process and verify their information. Registration requires the User to provide accurate, complete, and up-to-date personal details in the designated registration form. The User is responsible for ensuring that their information remains valid throughout their use of the Platform.

    3.2. Verification and Account Suspension

    The Platform Administration reserves the right to verify the accuracy of the User’s registration data at any time. If there is any reason to suspect that the information provided is false, incomplete, or misleading, the Platform may:

    • Request the User to confirm their registration details and provide supporting documents.
    • Temporarily suspend access to the User’s account until verification is completed.
    • Delete the User’s account if the provided documents do not match the registration data or if the User fails to provide the requested verification.

    3.3. Withdrawal of Consent

    The User has the right to withdraw their consent for the processing of their personal information at any time. To do so, they must send a written request to [email protected].

    3.4. User Identification and Login Credentials

    • The User is identified on the Platform using their login credentials.
    • The Platform Administration reserves the right to assign and manage login details and passwords at its discretion.

    3.5. Restrictions on Use

    The User is strictly prohibited from:

    • Copying, reproducing, distributing, or transmitting any part of the Platform’s services or content.
    • Using any materials from the Platform for commercial purposes without prior authorization.

    3.6. Account Suspension and Termination

    The Platform Administration has the right to temporarily suspend or permanently delete a User’s account under the following conditions:

    • If there is reason to believe that the User has violated this Agreement.
    • If the User provides incomplete, inaccurate, or outdated registration details, or if false information has been intentionally submitted.
    • If the User is found to be in violation of UK intellectual property laws.
    • If the User has not logged into their account or used the Platform for more than 12 months from the date of registration.

    In the event of account suspension or deletion, the Platform Administration will notify the User within one (1) day after the action has been taken.

    4. Content Posting on the Platform

    4.1. Responsibility for Posted Content

    By uploading or sharing informational and consulting materials on the Platform, the User assumes full responsibility for the accuracy, legality, and compliance of all published content. This includes, but is not limited to:

    • Lectures,
    • Tests and quizzes,
    • Educational resources,
    • Answers and solutions.

    The User is solely responsible for ensuring that their materials comply with the Platform’s content policies, applicable legal regulations, and intellectual property rights.

    4.2. User’s Warranties and Rights

    By posting content on the Platform, the User confirms and guarantees that:

    They own or have obtained the necessary licenses, rights, consents, permissions, and legal authority to grant the Platform a non-exclusive, limited license to display and distribute their contributions as specified in this User Agreement.

    The publication of such content does not violate third-party intellectual property rights or applicable laws.

    The User retains ownership of their content, but grants the Platform the right to host, display, and make it available to other Users in accordance with the terms of this Agreement.

    4.3. Compliance with Intellectual Property and Qualifications

    The User guarantees that:

    Their published materials do not infringe the intellectual property rights of third parties.

    They possess the necessary qualifications, expertise, or experience (including relevant education, training, and skills) to provide the informational and consulting services they offer through their posted content.

    The Platform does not verify the qualifications of Users or the accuracy of the content, and the responsibility for ensuring compliance with legal and intellectual property regulations lies entirely with the User.

    4.4. Prohibited Actions and Content

    The User agrees not to post, distribute, or engage in any of the following activities:

    Uploading or sharing inaccurate, misleading, offensive, defamatory, discriminatory, obscene, or illegal content.

    Posting advertisements, commercial promotions, or spam unrelated to educational or consulting activities.

    Using the Platform for any business purposes unrelated to educational consulting and informational services.

    Engaging in any activity that would require the Platform to obtain licenses, pay royalties, or assume liability for third-party content (e.g., using copyrighted music, media, or materials without permission).

    Impersonating another individual or attempting to gain unauthorized access to another User’s account.

    Disrupting or interfering with other Users’ experience on the Platform, including spamming, harassment, or misuse of Platform features.

    4.5. Pricing and Monetization of User Content

    The User who uploads materials on the Platform has the right to set the price for their content and determine its availability for purchase by other Users.

    The Platform reserves the right to set commission fees, which will be deducted from the revenue generated from paid content.

    The Platform does not guarantee a specific number of sales or any financial success from the monetization of content.

    Users retain the right to remove their content from the Platform at any time, except in cases where it has already been sold or sublicensed under a separate agreement.

    5. Rights to Use Posted Content

    5.1. Granting Rights to the Platform Administration

    By posting materials on the Platform, the User grants the Platform Administration the right to:

    • Offer, sell, distribute, and otherwise use the User’s posted content within the Platform’s services.
    • Sublicense the User’s content to third parties, including other Users, resellers, distributors, and affiliated sites.

    This means that once the User’s content is made available on the Platform, the Platform Administration has the right to use it for commercial and non-commercial purposes as outlined in this Agreement.

    5.2. Right to Remove Content

    Unless otherwise stated in a separate agreement, the User has the right to remove any or all of their posted content from the Platform at any time. However, content that has already been sublicensed, purchased, or distributed through third parties may still remain accessible where applicable.

    6. Terms of Paid Services and Payments

    6.1. General Conditions for Paid Services

    • The scope, terms, and conditions of the Platform’s paid services depend on the type of service purchased by the User.
    • The User acknowledges that certain features and materials may only be accessible through payment.

    6.2. Payment Methods

    • The User can pay for services using non-cash payment methods, including payment systems available on the Platform.
    • Available payment methods and conditions for transactions are detailed on the Platform’s website.

    6.3. Payment Processing and User Responsibilities

    • The Platform Administration is not responsible for errors caused by incorrect payment input, such as mistakes in entering SMS codes, capitalization, punctuation, or incorrect payment details.
    • The User is solely responsible for ensuring that payment is made correctly and in accordance with the payment system’s requirements.

    6.4. Third-Party Payment Systems

    • The Platform Administration is not responsible for payment processing issues caused by third-party services.
    • In case of non-transfer, partial transfer, or delay in funds, the Platform Administration bears no liability, and the User should contact their payment service provider.

    6.5. Complaints Regarding Paid Services

    • If the User encounters an issue with a paid service, they must submit a complaint:
      • During the service period (if the service has an active duration).
      • Within two (2) hours after the service has been provided (if the service does not require an ongoing validity period).
    • Complaints must be sent in writing via the Platform’s support email ([email protected]) or mailed to the Platform Administration’s address.

    A complaint must include:

    • A detailed explanation of how the service did not meet the agreed terms.
    • Supporting evidence, such as screenshots, transaction details, or other relevant proof.

    However, screenshots alone do not serve as definitive proof of an improperly provided service.

    If no complaint is submitted within the specified period, the service is considered properly provided and accepted by the User.

    6.6. Refund Policy

    The User is not entitled to a refund for services if they:

    • Fail to properly use the purchased services for reasons unrelated to the Platform Administration.
    • Experience external issues (e.g., loss of internet access due to the User’s service provider).
    • Have violated the terms of this Agreement, including unauthorized use or distribution of materials.

    Refunds may only be issued in cases where the Platform Administration is directly responsible for the failure of the paid service.

    Refund Request Procedure

    The User may request a refund within 30 days of purchasing a course, provided that they have not completed a significant portion of the material.

    To initiate a refund request, the User must contact support at [email protected] and provide the following information:

    • Username (Nickname) on CoursePlanet
    • Course name
    • Percentage of material covered
    • Date of purchase

    When reviewing a refund request, the Platform Administration considers the amount of material completed. If the User has completed the entire course or a significant portion of it, a refund will not be granted.

    If there is suspicion of a violation of the User Agreement, the Platform Administration reserves the right to:

    • Deny the refund request, and
    • Request additional documents from the User, including:
      • A written refund request with a signature,
      • A printed receipt of purchase, and
      • A copy of the User’s passport.

    These documents must be sent by postal mail to the Platform Administration’s registered address.

    Processing Time for Refund Requests

    The standard processing time for refund requests is up to 14 business days after receiving the request via email.

    If the refund request requires additional verification (e.g., suspicion of violation of the Agreement or submission of physical documents), the processing time may take up to 3 months from the date the documents are received by postal mail.

    By using the Platform’s paid services, the User acknowledges and agrees to these refund policies, including the conditions, processing times, and requirements for refund eligibility.

    7. Additional Terms

    7.1. Dispute Resolution

    The User and the Platform Administration agree that any disputes arising from this Agreement shall be resolved in accordance with the current legislation of the United Kingdom.

    7.1.1. Alternative Dispute Resolution (ADR) Methods

    Before initiating formal legal proceedings, the Parties agree to make reasonable efforts to resolve any disputes through negotiations and alternative dispute resolution methods (ADR), including but not limited to:

    1. Negotiations – The User and the Platform Administration shall attempt to resolve disputes amicably by exchanging written communications and discussing possible solutions within 30 days from the date the dispute arises.
    2. Mediation – If negotiations do not lead to a resolution, either Party may propose mediation with a neutral third party to facilitate a mutually acceptable settlement. Mediation shall take place within 60 days of the proposal. The costs of mediation shall be shared equally between the Parties unless otherwise agreed.
    3. Arbitration (if mutually agreed upon) – If mediation is unsuccessful, the Parties may voluntarily submit the dispute to arbitration under the rules of an accredited arbitration body in the United Kingdom. The arbitration decision shall be final and binding on both Parties.

    7.1.2. Formal Legal Proceedings

    If the dispute cannot be resolved through negotiations, mediation, or arbitration (where applicable), either Party retains the right to bring legal action before the courts of the United Kingdom in accordance with applicable laws.

    By accepting this Agreement, the User acknowledges and agrees that alternative dispute resolution mechanisms shall be considered as a primary means of resolving disputes before resorting to formal litigation.

    7.2. Consumer Rights and Free Services

    The User acknowledges that consumer protection laws do not apply to services provided free of charge by the Platform.

    Only paid services are subject to relevant consumer protection regulations.

    7.3. Relationship Between the Parties

    Nothing in this Agreement shall be interpreted as establishing:

    • Agency relationships
    • Partnerships or joint ventures
    • Employment contracts
    • Any other legal relationship between the User and the Platform Administration, unless explicitly stated in this Agreement.

    7.4. Partial Invalidity of the Agreement

    If any provision of this Agreement is deemed invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.

    7.5. Enforcement of Rights

    The Platform Administration’s failure to take immediate action against a violation of this Agreement by a User does not constitute a waiver of its rights.

    The Platform Administration reserves the right to take action at any time to protect its legal and commercial interests.

    8. Payments and Commissions

    8.1. Taxes and Payment Obligations

    All Users are required to pay applicable taxes related to their use of the Platform’s services, unless otherwise stated in this Agreement.

    Tax obligations may vary based on the User’s location and applicable tax laws.

    8.2. Accepted Payment Methods

    The Platform supports the following payment methods:

    • VISA
    • MasterCard

    Additional payment methods may be introduced at the Platform Administration’s discretion.

    9. Fees and Commissions

    9.1. Service Fee

    The Platform charges a 10% commission on the price of any paid content or materials purchased through the Platform.

    9.2. Commission Deduction

    This 10% commission is deducted directly from the revenue earned by the User who has posted the paid content.

    9.3. Transaction Fees

    The Platform may apply additional transaction processing fees depending on the chosen payment method.

    By registering and using the Platform’s services, the User acknowledges and agrees to these fees.

    10. Intellectual Property Rights

    10.1. Ownership of the Platform’s Content and Software

    The User acknowledges that all services, software, and proprietary information related to the Platform are the exclusive property of the Platform Administration or other rightful copyright holders.

    All such materials are protected under UK intellectual property laws and other applicable regulations.

    10.2. Protection of Advertisements and Information

    The User acknowledges that any advertisements, informational materials, and digital content made available through the Platform are subject to intellectual property protection.

    Unauthorized copying, distribution, modification, or use of such materials is strictly prohibited.

    Final Acknowledgment

    By using the Platform and its services, the User confirms that they have read, understood, and unconditionally accepted all the terms outlined in this Agreement.
